Kullanım Şartları

Bu Kullanım Şartları (“Şartlar”), Connfig markası altında sunulan web sitesi, platform ve ilişkili hizmetlerin (toplu olarak “Hizmet”) kullanımına ilişkin sizinle Connfig (“biz”, “bize”, “bizim”) arasındaki yasal sözleşmeyi düzenler. Hizmete kayıt olarak veya Hizmeti kullanarak bu Şartları kabul etmiş sayılırsınız.

1. Hizmetin Tanımı

Connfig; satış, pazarlama, satın alma ve iş geliştirme ekiplerinin ihtiyaç duyduğu işletme verilerini, CRM ve kampanya araçlarını sağlayan bir B2B büyüme platformudur. Hizmetin kapsamı, yeni özelliklerin eklenmesi, mevcut özelliklerin değiştirilmesi veya kaldırılması ile zaman içinde güncellenebilir.

2. Hesap ve Kayıt

  • Hizmeti kullanabilmek için en az 18 yaşında olmanız gerekir.
  • Kayıt sırasında doğru, güncel ve eksiksiz bilgi vermekle yükümlüsünüz.
  • Hesap kimlik bilgilerinizin gizliliğinden ve hesabınız üzerinden gerçekleştirilen tüm faaliyetlerden siz sorumlusunuz.
  • Yetkisiz erişim şüphesi durumunda derhal support@connfig.com adresinden bizimle iletişime geçmelisiniz.

3. Abonelik, Ücretlendirme ve Ödeme

  • Connfig planları aylık veya yıllık abonelik şeklinde sunulur. Geçerli fiyatlandırma fiyatlandırma sayfasında belirtilir.
  • Ödemeler Zotlo (Z3P Yazılım Anonim Şirketi) ödeme altyapısı üzerinden işlenir. Ödeme bilgilerini sağlayarak ilgili Zotlo kullanım şartlarını ve ödeme politikalarını da kabul etmiş olursunuz.
  • Abonelikler iptal edilmediği sürece dönem sonunda otomatik olarak yenilenir.
  • Deneme süresi içinde aboneliğinizi iptal etmezseniz, deneme sonunda seçtiğiniz planın tam ücreti ödeme yönteminizden tahsil edilir.
  • Vergi ve harçlar yürürlükteki mevzuata göre faturanıza yansıtılabilir.

4. Kabul Edilebilir Kullanım

Hizmeti kullanırken aşağıdakileri yapmamayı kabul edersiniz:

  • Yürürlükteki yasaları, üçüncü taraf haklarını veya bu Şartları ihlal etmek.
  • Hizmete veya altyapısına zarar verecek; tersine mühendislik, kazıma (scraping), otomatik erişim, aşırı yük testi gibi yetkisiz işlemler gerçekleştirmek.
  • İzinsiz e-posta veya istenmeyen ileti (spam) göndermek.
  • Hizmet üzerinden elde edilen verileri yasalara aykırı, yanıltıcı veya zarar verici amaçlarla kullanmak.
  • Hesabınızı veya erişim haklarınızı üçüncü taraflara devretmek, kiralamak veya satmak.

5. Veri ve Gizlilik

Kişisel verilerinizin işlenmesi, toplanması ve korunması Gizlilik Politikamız’a tabidir. Hizmet kapsamında platformumuza yüklediğiniz veya Connfig veri tabanından eriştiğiniz iş verilerini, yürürlükteki veri koruma mevzuatı (KVKK, GDPR ve benzeri) çerçevesinde kullanmakla yükümlüsünüz.

6. Fikri Mülkiyet

Hizmet, içeriği, yazılım, marka, logo ve diğer tüm fikri mülkiyet hakları Connfig’e veya lisans verenlerine aittir. Size, bu Şartlar ve aşağıda yer alan EULA çerçevesinde, sınırlı, münhasır olmayan, devredilemez bir kullanım hakkı verilir.

7. Üçüncü Taraf Hizmetleri

Hizmet, Zotlo gibi üçüncü taraf hizmetleri içerebilir veya bunlara bağlanabilir. Bu hizmetlerin kendi şart ve politikaları vardır; ilgili hizmetin kullanımından doğan haklar ve yükümlülükler ilgili sağlayıcıyla sizin aranızdadır.

8. Hizmetin Askıya Alınması ve Sonlandırılması

İşbu Şartları ihlal ettiğinizi veya Hizmeti yetkisiz biçimde kullandığınızı tespit etmemiz hâlinde hesabınızı askıya alma veya kapatma hakkını saklı tutarız. Aboneliğinizi dilediğiniz zaman hesap ayarlarından iptal edebilirsiniz; iptal mevcut faturalama döneminin sonunda yürürlüğe girer.

9. Garanti Reddi

Hizmet “OLDUĞU GİBİ” ve “MEVCUT OLDUĞU ŞEKİLDE” sunulmaktadır. Yürürlükteki yasaların izin verdiği azami ölçüde, açık veya zımni hiçbir garanti vermeyiz; satılabilirlik, belirli bir amaca uygunluk ve ihlal etmeme dâhil tüm zımni garantileri reddederiz.

10. Sorumluluk Sınırlaması

Yürürlükteki yasaların izin verdiği azami ölçüde, Connfig hiçbir durumda dolaylı, arızi, özel, cezai veya sonuçsal zararlardan; kâr, gelir, veri veya itibar kaybından sorumlu tutulamaz. Connfig’in toplam sorumluluğu, talebin ortaya çıkmasından önceki on iki ay içinde Connfig tarafınızdan tahsil edilen abonelik ücretleri ile sınırlıdır.

11. Tazminat

Hizmeti yasalara veya bu Şartlara aykırı kullanmanız nedeniyle ortaya çıkabilecek üçüncü taraf taleplerine karşı Connfig’i tazmin etmeyi kabul edersiniz.

12. Şartlardaki Değişiklikler

Bu Şartları zaman zaman güncelleyebiliriz. Önemli değişiklikler için e-posta veya Hizmet üzerinden bildirimde bulunulur. Değişikliklerin yürürlüğe girmesinden sonra Hizmeti kullanmaya devam etmeniz, güncel Şartları kabul ettiğiniz anlamına gelir.

13. Uygulanacak Hukuk ve Yetkili Mahkeme

Bu Şartlar Türkiye Cumhuriyeti yasalarına tabidir. Şartlardan doğan tüm uyuşmazlıklarda İstanbul Merkez (Çağlayan) Mahkemeleri ve İcra Daireleri yetkilidir.

Zotlo — Developer Standard End-User License Agreement

This end-user license agreement is between you and the developer or provider of applications, games, content and other digital products and other in-app services (the “Content”) made available via the Zotlo website, related features and services, and other linked channels, mobile websites or applications (collectively, the “Zotlo Platform”) (“Content Provider”) and consists of the terms below (“EULA” or “Agreement”).

This is a legal agreement between you and Content Provider stating the terms that govern license rights over the licensed Content (the “Licensed Content”) during your use of the Licensed Content made available through the Zotlo Platform by Z3P Yazılım Anonim Şirketi (referred to herein as “Zotlo”) which allows end users to purchase, sublicense, download or subscribe to applications, games and other digital products and services.

BY DOWNLOADING AND/OR BY USING THE LICENSED CONTENT, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT AND THAT YOU HAVE ACCEPTED THESE TERMS AND CONDITIONS. YOU ACKNOWLEDGE THAT THIS AGREEMENT IS CONCLUDED BETWEEN YOU AND THE CONTENT PROVIDER, AND NOT WITH ZOTLO WHERE THE LICENSED CONTENT HAS BEEN OFFERED. YOU FURTHER ACKNOWLEDGE THAT THE CONTENT PROVIDER IS SOLELY RESPONSIBLE FOR THE LICENSED CONTENT, THE CONTENT THEREOF AND FOR ANY CLAIMS, ANY WARRANTY AND ANY SUPPORT RELATING TO THE LICENSED CONTENT OR THIS AGREEMENT.

1. Scope of the License

The Licensed Content made available through the Zotlo Platform is licensed, not sold, to you. Your license to the Licensed Content is subject to your prior acceptance of either this EULA, or a custom end-user license agreement between you and Content Provider (“Custom EULA”), if one is provided. Your license to the Licensed Content under this EULA or Custom EULA is granted directly by Content Provider and Zotlo has no obligation or responsibility over your license to this Licensed Content. Content Provider reserves all rights in and to the Licensed Content not expressly granted to you under this EULA.

Content Provider grants you a non-exclusive, non-sublicensable and non-transferable license to use the Licensed Content within the limits of this EULA on products that you own or control, strictly and solely for your personal, noncommercial use (“Purpose”). Content Provider reserves all rights not expressly granted to you.

You agree to use the Licensed Content at your own risk. The terms of this EULA will govern any content, materials or services accessible from or purchased within the Licensed Content as well as updates provided by Content Provider to the Licensed Content, unless such updates are accompanied by their own EULA. Unless expressly provided otherwise, you may not distribute or make the Licensed Content available over any network or devices. You may not transfer, redistribute or sublicense the Licensed Content nor copy, reverse-engineer, disassemble, modify, adapt, translate or create derivative works of the Licensed Content, any updates or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law).

2. Consent to Use of Data

You agree that Content Provider may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Licensed Content. Content Provider may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you, in accordance with applicable data-protection laws (including KVKK and GDPR where applicable) and Content Provider’s privacy policy.

3. Subscriptions and Auto-Renewal

The Licensed Content may be offered on a subscription basis. Where you purchase a subscription:

  • Subscriptions automatically renew at the end of each billing period at the then-current price unless cancelled before the renewal date.
  • Free trials, if offered, will convert to a paid subscription unless cancelled before the end of the trial.
  • Payment, billing, refunds and cancellation are handled in accordance with the rules of the platform through which you purchased the subscription, including the Zotlo Platform.
  • You may manage and cancel your subscription at any time through your account or device settings.

4. Termination

This EULA is effective until terminated by you or Content Provider. Your rights under this EULA will terminate automatically without notice from Content Provider if you fail to comply with any of its terms. Upon termination of this EULA you must cease all use of the Licensed Content and destroy all copies, full or partial, of the Licensed Content under your control.

5. External Services

The Licensed Content may enable access to Content Provider’s and/or third-party services and websites (collectively and individually, “External Services”). You agree to use the External Services at your sole risk. Content Provider is not responsible for examining or evaluating the content or accuracy of any third-party External Services and shall not be liable for any such third-party External Services. Data displayed by any Licensed Content or External Service is for general informational purposes only and is not guaranteed by Content Provider or its agents. You will not use the External Services in any manner that is inconsistent with the terms of this EULA or that infringes the intellectual property rights of any third party or Content Provider.

6. NO WARRANTY

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED CONTENT IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED CONTENT IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND CONTENT PROVIDER HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED CONTENT, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT AND OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.

7. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL CONTENT PROVIDER BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED CONTENT, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF CONTENT PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CONTENT PROVIDER’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE AMOUNT PAID BY YOU FOR THE LICENSED CONTENT IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Export Control

You may not use or otherwise export or re-export the Licensed Content except as authorized by the laws of the jurisdiction in which the Licensed Content was obtained. In particular, but without limitation, the Licensed Content may not be exported or re-exported (a) into any sanctioned country or (b) to anyone on any list of restricted parties maintained by competent authorities. By using the Licensed Content, you represent and warrant that you are not located in any such country or on any such list.

9. Government End Users

The Licensed Content and related documentation are “Commercial Items”, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation”, as such terms are used in applicable government regulations. Consistent with such regulations, the Licensed Content and related documentation are licensed to government end users only as Commercial Items and with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

10. Governing Law

Except to the extent expressly provided in the following paragraph, this EULA and the relationship between you and Content Provider shall be governed by the laws of the jurisdiction designated in the Custom EULA or, in the absence thereof, by the laws of the Republic of Türkiye, excluding its conflicts-of-law provisions. Your use of the Licensed Content may also be subject to other local, state, national or international laws.

11. No Undertaking by Zotlo

No undertaking, commitment or promise is made by Zotlo with respect to the Licensed Content. Content Provider is solely responsible for the Licensed Content, including any maintenance, support, warranty and liability claims, and Zotlo is not a party to this EULA.

12. General Provisions

  • If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • This EULA constitutes the entire agreement between you and Content Provider with respect to the Licensed Content and supersedes all prior or contemporaneous understandings.
  • Failure by Content Provider to enforce any right or provision of this EULA does not constitute a waiver of such right or provision.
  • Content Provider may amend this EULA at any time by posting an updated version. Continued use of the Licensed Content after the effective date constitutes your acceptance of the amended EULA.
